Συνεχώς όλο και περισσότερα νομικά και φυσικά πρόσωπα επιθυμούν να διοργανώσουν έναν αγώνα τριάθλου, ποδηλασίας, τρεξίματος, κολύμβησης …και γενικότερα το ερώτημα που έχουν και μας απευθύνουν οι αναγνώστες μας είναι ” μπορώ ή όχι να διοργανώσω έναν αγώνα” ;
Ας δούμε πως έχει η κατάσταση.
- Ευρωπαική Νομοθεσία. Δυστυχώς ή ευτυχώς ανήκουμε στην Ευρωπαική Ενωση και σύμφωνα με την αυτή ο αθλητισμός είναι Οιικονομική δραστηριότητα και αυτό προκύπτει από μία σειρά σχετικών ντιρεκτίβων. Ο κ. Κάιπερς υπεύθυνος του γραφείου αθλητισμού της Ευρωπαικής Ενωσης στις Βρυξέλλες -και κατόπιν σύμβουλος του κ. Ρογκ – είχε ρωτηθεί σχετικά επι αυτού από εμάς το 2001 και μας τόνισε ότι υπάρχουν 19 ντιρεκτίβες της ΕΕ βάσει των οποίων ο αθλητισμός αναγνωρίζεται και αντιμετωπίζεται όπως οποιαδήποτε Οικονομική Δραστηριότητα. Συνεπώς μπορούμε να σταθούμε απένανται στα θέματα του αθλητισμού μόνο βλέποντας τα θέματα μέσα από αυτό το πρίσμα. Εάν εμείς θέλουμε να κάνουμε ένα ευρωπαικό πρωτάθλημα συλλόγων μπάσκετ με την επωνυμία «Suprolegua» μπορούμε να το κάνουμε και δεν χρειάζεται η έγκριση της FIBA. Δεν θα εχει κυρώσεις κάποιος σύλλογος εάν συμμετέχει σε ένα τέτοιο πρωτάθλημα. Κυρώσεις θα έχουν τα κράτη μέλη της ΕΕ εάν δεν σεβαστούν αυτές τις ντιρεκτίβες. Εάν η ελληνική νομοθεσία ήταν αντίθετη στην Ευρωπαική τότε θα είχαμε πάλι πρόστιμα. Ευτυχώς δεν είναι!
- Ενημέρωση Λιμενικού & Αστυνομίας. Στα «αθλήματα δρόμου» όπως ονομάζονται στην διεθνή αθλητική ορολογία πριν κάνουμε μία εκδήλωση οφείλουμε να ενημερώσουμε το Λιμενικό (εάν πρόκειται για κολύμβηση), την Αστυνομία/ Τροχαία εάν πρόκειται για αγώνα Τρεξίματος, Ποδηλασίας. (Σημείωση : O KOK προέβλεπε την άδεια από την Ομοσπονδία Ποδηλασίας ακόμα και σε περιπτώσεις αγώνα Τριάθλου. Ετσι επι χρόνια τα σωματεία Τριάθλου και η Ελληνική Ομοσπονδία Ερασιτεχνικού Τριάθλου ζητούσε άδεια από την ΕΟΠ). Γίνεται να μην δώσει έγκριση η Αστυνομία η το Λιμενικό; Οχι δεν γίνεται κάτι τέτοιο, ιδίως εάν είναι κάτω από την αιγίδα του Δήμου. Μπορεί να συστήσει άλλη ημερομηνία (εάν π.χ. είμαστε στο μέσο του καλοκαιριού και θέλουμε να κάνουμε αγώνα σε πολυσύχναστο τουριστικό θέρετρο) όμως μέχρι εκεί. Οποιοσδήποτε Λιμενάρχης ή Αστυνόμος – εάν δεν είναι παρανοικός- εάν κάτι διεξάγεται κάτω από την αιγίδα του Δήμου θα το στηρίξει και θα αγνοήσει οποιοδήποτε άλλο πρόσωπο ιδιωτικού δικαίου που είναι αντίθετο σε αυτή την εκδήλωση. Γενικά είναι παρανοικό και απολύτως γραφικό το 2012 – είναι από αυτά που δεν μπορούν να καταλάβουν οι ξένοι για τους έλληνες- κάποιος να εναντιώνεται σε εκδήλωση που θέλει να κάνει η τοπική εξουσία, δηλαδή ο Δήμος. Να σημειώσουμε την παράννοια του ΚΟΚ για διάφορα θέματα που αφορούν τους ποδηλάτες όπως το να κινούνται οι ποδηλάτες σε 2άδες. Φανταστείτε να έρθει μία επαγγελματική ομάδα ποδηλασίας για προπόνηση στην Ελλάδα και να φάει πρόστιμο από έναν ελληνα αστυνομικό γιατί κινούνται σε δυάδες. Είναι αυτά για τα οποία γράφουμε ιστορία σε όλο τον κόσμο.
- Συμμετοχή του Δήμου. Στα αθλήματα δρόμου συνηθίζεται ο διοργανωτής να ενημερώνει και να ζητά την άδεια του Δήμου.Φυσικά και ο Δήμος μπορεί να διοργανώσει οποιονδήποτε αγώνα επιθυμεί. Είναι στην διακριτική ευχέρεια του Δήμου να ζητήσει την έγκριση ή να μην επικοινωνήσει με την Ομοσπονδία ή τις Ομοσπονδίες (εάν υπάρχουν περισσότερες από μία ομοσπονδίες σε ένα άθλημα). Δίχως την άδεια του Δήμου είναι δύσκολο να γίνει ένας αγώνας και γι΄ αυτό και οι διεθνείς ομοσπονδίες όταν θέλουν να συνεργαστούν με την εθνική ομοσπονδία για να γίνει ένας διεθνής αγώνα απαιτούν την έγγραφη συναίνεση του Δήμου. Στα αθλήματα δρόμου που δεν υφίσταται η έννοια της αθλητικής εγκατάστασης πρακτικά δεν μπορεί να γίνει ο αγώνας δίχως την συναίνεση του Δήμου. Θα μπορούσε κάποιος να διοργανώσει ένα αγώνα τέννις σε ιδιωτικές εγκαταστάσεις αλλά άθλημα δρόμου χωρίς την συγκατάθεση του Δήμου του θεωρούμε πρακτικά αδύνατο. (Δήμος εναντίον Ομοσπονδίας σημειώστε στάνταρ Ασσο).
- Τιμωρία Αθλητή. Η Ομοσπονδία μπορεί να τιμωρήσει έναν αθλητή που ανήκει σε σωματείο μέλος της που συμμετέχει σε αγώνα που δεν έχει την δική της έγκριση σύμφωνα με τον 2725/ 1999 (άρθρο 9 παρ. 6 και 33 παρ. 8). Ομως αυτό δεν έχει συμβεί ποτέ, μα ποτέ !, και νομίζουμε ότι ένας αθλητής δεν θέλει να ανήκει σε μία Ομοσπονδία που θέλει να τον έχει δέσμιο και του στερεί το δικαίωμα να συμμετέχει σε όποιον αγώνα θέλει.
- Αθλήματα Ιδιωτικής Πρωτοβουλίας. Το Τρίαθλο ανήκει πλέον στην 5η κατηγορία των αθλημάτων – αθλήματα Ιδιωτικής πρωτοβουλίας- και συνεπώς το ίδιο το κράτος προτρέπει τους ιδιώτες (δήμους, ιδιωτικές εταιρείες) να συμβάλουν στην ανάπτυξη του αθλήματος διοργωνώνοντας αγώνες και ελαφρύνοντας το κράτος οικονομικά.
- Νόμος. Ο Νόμος είναι πιο πάνω από οποιοδήποτε καταστατικό μίας ομοσπονδίας και ενός συλλόγου. Μπορεί να λέει ένα καταστατικό μίας ομοσπονδίας ότι θέλει (π.χ. «είμαστε η υπέρτατη αρχή ενός αθλήματος και είμαστε αποκλειστικά αρμόδιοι για την οργάνωση και διεξαγωγή των αγώνων»… Κολύμβησης, Ποδηλασίας, Τρεξίματος, Βόλει, Τριάθλου, Σκάκι, Χόκει κ.λπ.) όμως αυτό δεν σημαίνει τίποτα απολύτως. Το καταστατικό λέει ότι θέλει όμως δεν μπορεί να είναι υπεράνω της Ελληνικής- που είναι εναρμονισμένη με την Ευρωπαική- νομοθεσία.
- Αναγνώριση μίας Ομοσπονδίας. Η ΓΓΑ και/ η ΕΟΕ αναγνωρίζει μία Ομοσπονδία για να εκποσωπεί την Χώρα στα Διεθνή όργανα του αθλήματος και εάν θέλει την χρηματοδοτεί για τις εθνικές ομάδες και ίσως για την ανάπτυξη του αθλήματος. Ομως αυτό δεν σημαίνει ότι απαγορεύει την ανάπτυξη του αθλήματος μέσω Δήμων, μίας 2ης ή και 3ης Ομοσπονδίας, Μη Κερδοσκοπικού ή και Κερδοσκοπικού Οργανισμού.
- Ιδιωτική Εταιρεία. Μία ιδιωτική εταιρεία (ΟΕ, ΕΠΕ, ΑΕ ακόμα και ατομική επιχείρηση) έχει τα ίδια δικαιώματα με ένα αθλητικό σωματείο/ Ομοσπονδία και μπορεί να χρησιμοποιεί όποια επωνυμία θέλει σε μία εκδήλωσή της και φυσικά μπορεί να έχει όποια εμπορική δραστηριότητα θέλει, όπως π.χ. να διοργανώνει εκδηλώσεις αθλητικού ή πολιτιστικού χαρακτήρα. Δεν υπάρχει κανένας νόμος που πριμοδοτεί ή καθιστά ιδιαίτερο ενα αθλητικό σωματείο, έναν ΜΚΟ έναντι μίας εμπορικής εταιρείας. Το να εμποδίσει κάποιος μία εταιρεία να εξασκήσει την εμπορική της δραστηριότητα εφόσον δεν παραβιάζει την νομοθεσία είναι παράνομο και σε αυτές τις περιπτώσεις οι εταιρείες καταφεύγουν σε νομικές ενέργειες. Για να καταλάβουμε την αρρωστημένη νοοοτρπία που υπήρχε στην Ελλάδα επί χρόνια να αναφέρουμε ότι έξω όλα τα μεγάλα αθλητικά γεγονότα τα διοργανώνουν εταιρείες. Φυσικά αυτό είναι και προς το συμφέρον του κράτους καθώς εισπράττει φόρους.
- ΕΦΙΠ. Οποισδήποτε κινείται ενάντια στην ανάπτυξη ενός αθλήματος στην Ελλάδα θα πρέπει να καταγγέλεται άμεσα στην Επιτροπή Φιλάθλου Πνεύματος της Ελληνικής Ολυμπιακής Επιτροπής.
Τί συμβαίνει στην Ελλάδα ;
Καθώς πλέον αναγκαζόμαστε να γίνουμε χώρα της Ευρωπαικής Ενωσης όχι μόνο τυπικά αλλά και ουσιαστικά αναγκαζόμαστε να εγκαταλείψουμε το κρατικοκεντρικό μοντέλο ανάπτυξης του αθλητισμού -τύπου Ανατολικής Ευρώπης με προέδρους και μέλη ΔΣ να ανήκουν στο κυβερνών κόμμα. Βέβαια οι κακές συνήθειες δεν έχουν εξαληφθεί τελείως και φυσικά ακόμα ορισμένοι δεν έχουν ξεκολλήσει από τις κακές συνθήκες του παρελθόντος.
Δυστυχώς αρκετές Ομοσπονδίες στέλνουν επιστολές προς Δήμους, Αστυνομία, Λιμεναρχείο λέγοντας ότι μόνο αυτές μπορούν να διοργανώσουν αγώνες. Η απάντηση βέβαια είναι στις περισσότερες περιπτώσεις το να τους αγνοούν τελείως. Ιδίως οι Δήμοι όταν λάβουν τέτοια επιστολή γίνονται έξω φρενών.
Αναφέρουμε ως παράδειγμα ότι το 2005 που ο Δήμος Χανίων έκανε αγώνα τριάθλου και δεχόταν επιστολές από την Ελληνική Ομοσπονδία Τριάθλου δεν μπήκε καν στην διαδικασία να απαντήσει και φυσικά έκανε κανονικά τον αγώνα. Απαξίωσε τελείως την επιστολή της Ομοσπονδίας και καθώς έχουμε παραστεί μπροστά σε τέτοιες καταστάσεις οι Δήμαρχοι λένε με τον ένα ή άλλο τρόπο “Καλά ποιοι νομίζουν ότι είναι; Θα μας πουν τί θα κάνουμε στον Δήμο μας!” Πόσο μάλλο τώρα με την ευρωπαική και εθνική βούληση για αποκέντρωση εξουσίας και αρμοδιοτήτων όλα αυτά φαντάζουν ως φαντάσματα από το παρελθόν από αυτό που μας έφερε να είμαστε δαχτυλοδεικτούμενοι στην Ευρωπαική Ενωση.
Εχοντας διοργανώσει πολλούς αγώνες στην Ελλάδα να σημειώσουμε ότι όταν η Ομοσπονδία στέλνει απειλητικές επιστολές οι Δήμαρχοι γίνονται «Τούρκοι» και το παίρνουν προσωπικά και συμμετέχουν ακόμα πιο ενεργά στην διοργάνωση.
Πέρα από τα παραπάνω πρέπει όλοι να συμβάλλουμε στην ανάπτυξη του αθλητισμού και κυρίως οι ιδιώτες – ιδίως τώρα που το κράτος δεν έχει τους πόρους να το κάνει- και να απομονώσουμε όποιους λειτουργούν αρνητικά στην ανάπτυξη του αθλήματός μας.
Φέτος το αθλητικό καλεντάρι στο Τρίαθλο θα είναι πολύ πλούσιο καθώς το άθλημα ακολουθεί το πολύ επιτυχημένο μοντέλο ανάπτυξης που ισχύει στην Ευρωπαική Ενωση και στο τρέξιμο στην Ελλάδα με πλήθος Λαικών Αγώνων κάτω από την αιγίδα Δήμων και ιδιωτών.
Επιτέλους φαίνεται ότι γινόμαστε και ουσιαστικά χώρα της Ευρωπαικής Ενωσης και στον αθλητισμό αφήνοντας πίσω το κομματικό κράτος.
